I appreciate your efforts, but unfortunately you did not provide an answer to the problem I am seeing. aspnet_merge appears in the expected location. Perhaps this very busy Microsoft person could read through the entire thread here and make a comment? What
did this person say about System DLLs being copied in?
Ok well we have replicated your issue and resolved it again buy putting merge as described earlier
Are you saying you got them to appear in your build and then disappear with help from an official Microsoft employee? If so, would you care sharing the steps you used to make this happen.

Re: Upgraded Website has random DLL's appearing

We are trying to find out why the following DLLs appear in our bin directory when doing a build:
System.Data.dll
System.Data.OracleClient.dll
System.EnterpriseServices.dll
System.EnterpriseServices.dll
System.EnterpriseServices.Wrapper.dll
System.Transactions.dll
System.Web.dll
Are you saying you got them to appear in your build and then disappear with help from an official Microsoft employee? If so, would you care sharing the steps you used to make this happen.
